PERSONAL DATA PROTECTION INFORMATION AND CONSENT FORM

As Dr. Barış Çin, to provide the services to you, we may need to collect and store your personal and health information within the limits necessary for the services to be provided.

The health data we need to record in order to provide you with health services is considered as sensitive personal data under the law. According to Article 6, Paragraph 2 of the Law No. 6698 on the Protection of Personal Data, "Processing of special categories of personal data without the explicit consent of the data subject is prohibited." Therefore, personal health data can only be recorded with the explicit written consent of the individual, which necessitates obtaining your consent.

This consent covers personal data provided to us orally, in writing, visually, or electronically during your examination, and data obtained through internet and mobile applications or collected in our clinic (including demographic information, medical history, social-psychological-sexual status data that might affect health, test results, prescriptions, video recordings, patient surveys, photographs, etc.).

In this regard, the personal data necessary for providing the services includes, but is not limited to, your name, surname, Turkish ID number (or passport number or temporary Turkish ID number if you are not a Turkish citizen), place and date of birth, marital status, gender, various identification documents, address, phone number, email address, bank account number, IBAN number, clinical medical history, disease history, examination data, data related to the procedures applied to you, prescription information, photos, patient survey responses, any image, audio/video recordings, laboratory and imaging results, test results, data related to medical diagnoses, treatment and care services, health and sexual life data, private health insurance data, and Social Security Institution data.

Your personal data will be recorded and stored only to the extent necessary for providing the health services, in accordance with Law No. 6698 and relevant regulations. The data will be kept in our system/archives for no longer than necessary for achieving the purposes of recording. The processed data will be protected as a professional secret, ensuring confidentiality and will not be shared with third parties/institutions/organizations without the patient's explicit consent.

However, we would like to remind you that in cases where the privacy of personal medical records must be limited to protect public health, such as reporting infectious diseases under Article 58 of the Law No. 1593 on Public Health, or in cases of legal obligations like crime reporting, your data may be disclosed to the relevant authorities, limited to the purpose and proportionate to the situation. Also, your data may be shared with another physician for consultation purposes regarding your health status.

Requests from public institutions, judicial authorities, and other official bodies to transfer your data will be assessed based on the purpose of the request, whether the requested data aligns with the intended purpose, whether the purpose can be achieved without anonymizing your data, and whether such data transfer is necessary in a democratic society. Requests that do not meet these criteria will not be fulfilled.

Regarding the personal data recorded by us, under the Protection of Individuals against Automated Processing of Personal Data (Council of Europe Convention No. 108), the European Convention on Human Rights Article 8, the Constitution Article 20, and Law No. 6698:

• You have the right to learn whether your personal data is processed and the scope of the processed data.
• If your data is processed, you have the right to obtain information about it, access it, and receive a copy.
• You can learn the purpose of processing your data, whether it is used in accordance with that purpose, whether it is transferred to a third party or institution domestically or internationally, and request that changes to your personal data be communicated to those with whom it was shared.
• You have the right to request correction of incomplete or incorrect data.
